TERMS OF SERVICE

Welcome to ProTuff Products (“ProTuff PR Services LLC”). These Terms of Service (“Terms”) govern your access to and use of the website located at protuffproducts.com (the “Site”) and the products, services, and content made available through the Site (collectively, the “Services”) operated by ProTuff PR Services LLC (“ProTuff,” “we,” “us,” or “our”).

Please read these Terms carefully. By accessing or using the Site or purchasing any product through the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Site.

1. ELIGIBILITY

You must be at least 18 years old and capable of forming a binding contract to use the Site or purchase our products. By using the Site, you represent and warrant that you meet these requirements.

2. ACCOUNT REGISTRATION

Certain features of the Site, including product warranty registration, require you to create an account. You agree to (a) provide accurate and complete information, (b) keep your account credentials confidential, and (c) notify us promptly of any unauthorized use. You are responsible for all activity that occurs under your account.

3. PRODUCTS, ORDERS, AND PRICING

3.1 Product Descriptions. We aim to describe our products accurately, but we do not warrant that product descriptions, images, pricing, or other content on the Site are error-free, complete, or current. We reserve the right to correct errors and update information at any time without prior notice.

3.2 Pricing. All prices are listed in U.S. dollars and are subject to change without notice. Taxes, shipping, and handling fees are added at checkout where applicable.

3.3 Order Acceptance. Your placement of an order constitutes an offer to purchase. We reserve the right to accept, decline, limit, or cancel any order for any reason, including suspected fraud, product unavailability, or pricing errors. If we cancel an order after payment, we will issue a full refund.

3.4 Payment. By providing payment information, you authorize us (or our payment processor) to charge the payment method for the total order amount, including taxes and shipping.

4. SHIPPING AND DELIVERY

We ship to addresses within the regions specified at checkout. Estimated delivery times are provided for convenience and are not guaranteed. Risk of loss and title for products pass to you upon delivery to the carrier. Shipping policies, including free shipping thresholds, are described on the Site and may be updated from time to time.

5. RETURNS AND REFUNDS

Returns are accepted within thirty (30) days of delivery for products in new and unused condition, subject to the return policy posted on the Site. To initiate a return, contact us at info@protuffproducts.com. Refunds are issued to the original payment method after we receive and inspect the returned product. Shipping charges are non-refundable unless the return is due to our error or a defective product.

6. WARRANTY

ProTuff offers a 50% Lifetime Replacement Warranty on covered products. Under this warranty, the customer pays 50% of the current retail price of the replacement product, and ProTuff ships the replacement directly to the customer. Customers are NOT required to return the broken product. The warranty covers defects in materials and workmanship for the original purchaser and does not cover damage caused by misuse, normal wear of disposable components, or modifications. Certain residential customers may receive enhanced warranty terms as described in the product registration confirmation. THIS WARRANTY IS THE EXCLUSIVE WARRANTY PROVIDED BY PROTUFF AND REPLACES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

7. INTELLECTUAL PROPERTY

All content on the Site — including text, graphics, logos, images, product designs, and software — is owned by or licensed to ProTuff and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any Site content without our prior written permission, except as expressly allowed for personal, non-commercial use.

The “ProTuff” name and logo are trademarks of ProTuff Innovations LLC. All other trademarks, including “Amazon”, “Walmart” and any third-party retailer names, are the property of their respective owners.

8. USER CONDUCT

When using the Site, you agree NOT to:

– Use the Site for any unlawful purpose or in violation of these Terms;

– Attempt to gain unauthorized access to any portion of the Site or related systems;

– Interfere with or disrupt the Site, servers, or networks;

– Use automated means (bots, scrapers, etc.) to access the Site without our permission;

– Upload or transmit any harmful code, viruses, or malicious material;

– Impersonate any person or entity, or misrepresent your affiliation;

– Harass, abuse, or harm another person through use of the Site.

We reserve the right to terminate or restrict access to any user who violates these Terms.

9. DISCLAIMERS

THE SITE AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROTUFF, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ProTuff and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Site, (b) your violation of these Terms, or (c) your violation of any rights of a third party.

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Puerto Rico, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Puerto Rico, and you consent to the personal jurisdiction of such courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

13. CHANGES TO THESE TERMS

We may revise these Terms at any time by posting the updated version on the Site. Material changes will be indicated by an updated “Effective Date” at the top. Your continued use of the Site after any change constitutes acceptance of the revised Terms.

14. TERMINATION

We may suspend or terminate your access to the Site at any time, with or without cause and with or without notice, for any reason. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
